OSHA Regulation Threatens Firearm, Ammunition Industry PDF Print E-mail

Temporarily Withheld Pending Further Review after Complaints

The Sporting Arms and Ammunition Manufacturers’ Institute (SAAMI) reports that the US Department of Labor is retracting, pending a full review, OSHA’s proposed new regulations for explosives(29 CFR 1910.109 et seq.)

A bi-partisan group in Congress has convinced OSHA to table the proposed regulations for the time being.

Reportedly 26 members of Congress have expressed concerns regarding OSHA proposed explosives rules. The Congressional opposition along with NRA grass roots initiatives and others have made OSHA understand the necessity to revise its notice of proposed rulemaking and clarify the purpose of the regulation.

OSHA is proposing a regulatory rule affecting the manufacturing, transportation and storage of small arms ammunition, primers, and smokeless propellants.

Phoenix Labs estimates that the proposed rule would force the closure of nearly all ammunition manufacturers and force the cost of small arms ammunition to skyrocket beyond what the market could bear, essentially collapsing the industry.

Ammunition and smokeless propellant manufacturers would have to shut down and evacuate a factory when a thunderstorm approached and customers would not be allowed within 50 feet of any ammunition displayed in stores or stored without first being searched for matches or lighters.

Another proposed rule would prohibit the possession of firearms in a facility containing ammunition or explosives.

This is being interpreted as outlawing gun stores and giving Wall Mart a choice of selling guns or ammunition, but not both in the same facility.
