The South Carolina Public Interest Foundation, Edward D. Sloan, Jr., and Robert M. Lloyd have filed a Complaint for Injunctive Relief with the Court of Common Pleas in Greenville, alleging that the Cliffs of Glassy has constructed a road that crosses over land owned by the City of Greenville and has “allowed residents of its gated development to use the road, without permission or excuse.
Court documents state that the encroachment took place as early as 2003 and that Mayor Knox White and the City of Greenville “has taken no action to repel this encroachment, or to protect the City’s land in any way.”
The property in question is described as being located in Greenville County at a point approximately 600 feet south of Corbin Mountain Fire Tower.
The Court is asked to require the City to mark the property line between the city and the Cliffs property with a fence or wire no later than May 1, 2008 and maintain it until July 1, 2008.
Sloan further asks the Court to require the Cliffs to remove the said encroachment from land owned by the City and to restore the land to its previous condition to the maximum practicable extent.
In addition, the Plaintiffs asked the Court to abstain from obstructing the Plaintiffs occasional visits to the site during normal business hours until July 1, 2008, to inspect the site and its restoration.
The Court is asked to award the Plaintiff attorneys’ fees and costs of litigation pursuant to the SC Code.
The complaint was filed with the court Monday, March 24 at 4:57 p.m. by James G. Carpenter, attorney for the Plaintiffs.
