Sloan Requests Hearing in Contested Cases
Edward D. Sloan, Jr. submitted claims for refunds of overpaid taxes to the Greenville County Auditor on March 1 and March 19, 2008. He has received no response and has given Notice of Appeal of the Greenville County Auditor’s “constructive denial” of those claims.
Requests for hearing in the contested matter have been filed with the Administrative Law Court in Columbia, South Carolina. Sloan has petitioned the Court to order the refund requested and reimbursement of his costs and attorney’s fees.
An unknown number of Greenville County Taxpayers have submitted claims to the County Auditor with no response to date.
The claims were in response to discovery by the Greenville County Auditor that the Greenville County School Board had overcharged district taxpayers approximately $7 million for 2006 and the inflated amount has been carried forward into 2007.
The Greenville County Taxpayers Association obtained documents showing the overcharge through a South Carolina Freedom of Information request. (See The Times Examiner, Wednesday, February 20 2008. Article titled: “Property Owners May Protest Taxes Taken Illegally by School District.)
The Greenville County Attorney has been researching the matter and at press time, Monday, April 14, no method of reimbursement for the overcharge had been announced.
At this juncture, it appears that it may be necessary for a court to decide the method for reim-bursement of funds collected illegally and the source of funds for reimbursement.
Laws governing the formulas for funding school districts were passed by the South Carolina General Assembly. Greenville County Taxpayer Association President Robert G. “Butch” Taylor asked the Greenville County Legislative Delegation for assistance in resolving the taxation matter during a meeting Monday night at Greenville County Square.
